Up to this day, cannabis is technically a drug, except for hemp. This is because hemp doesn\u2019t have the psychotropic ingredient that marijuana has. However, it does contain <a href=\"https:\/\/www.growbarato.net\/598-cbd\" target=\"_blank\" rel=\"noopener\">CBD<\/a>, known for its relaxing and therapeutic effects, which the WHO admits as a substance with health benefits. Although some of these benefits aren&#8217;t scientifically confirmed, there is some evidence regarding its anti-inflammatory properties.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Spanish_Penal_Code_regarding_marijuana\"><\/span>The Spanish Penal Code regarding marijuana<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The Spanish Penal Code punishes in article 368 the <strong>cultivation, elaboration, trafficking<\/strong> or any other activity that promotes or facilitates the consumption of psychotropic substances. On the other hand, the Law on Public Safety, also known as \u201cGag Rule\u201d, says that it is a<br>\u201cserious penalty to have or consume drugs, even if the user isn&#8217;t trafficking, in public places or public transportation services\u201d.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter\"><img decoding=\"async\" src=\"https:\/\/www.growbarato.net\/blog\/wp-content\/uploads\/2023\/03\/mazo-juez-y-hoja-de-marihuana.jpg.webp\" alt=\"how many marijuana plants can you grow\" title=\"legal cannabis situation in Spain\"\/><\/figure>\n<\/div>\n\n\n<p>However, a person can carry<strong> up to 100 grams of cannabis<\/strong> for self-consumption; which is the dose that could correspond to between 3-5 days. More than that amount is a crime against public health, according to the Penal Code, and it can be punished with between 3 and 6 years in prison.<\/p>\n\n\n\n<p>The \u201cGag Law\u201d is also very specific about marijuana grows and says that they <strong>can&#8217;t be visible from the street<\/strong>. In conclusion, in Spain, growing your own marijuana plants for self-consumption is legal as long as the plants aren&#8217;t perceptible for people walking by in the street (neighbors, children, etc.) and that the flowers are for self-consumption.<\/p>\n\n\n\n<p>What is curious is that <strong>it doesn\u2019t specify how many marijuana plants can you grow<\/strong>, it only says that they can\u2019t be visible from the outside of the private property. Of course, even if it is apparently legal to grow marijuana plants, you shouldn\u2019t grow past the limits of common sense in order not to make authorities think that your grow is not for self-supply.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Spanish_Proposals_for_cannabis_legalization\"><\/span>Spanish Proposals for cannabis legalization<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>On the 24th of September of 2021, \u201cUnidas Podemos\u201d made a proposal to the political party in charge about <strong>decriminalizing the consumption and <\/strong>possession of marijuana, alleging that they needed to regulate an already existing reality in the country.<\/p>\n\n\n\n<p>One month later, M\u00e1s Pa\u00eds took another proposal to the Congress of Deputies; where it mentioned the possibility o<strong>f legalizing consumption for people over 18 years old and<\/strong> <strong>allowing users to grow of up to 12 marijuana plants for self-supply<\/strong>. This proposal also suggests the possibility of adding up to 35% of taxes on top of the final price when its use isn\u2019t for therapeutic use or investigation.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter\"><img decoding=\"async\" src=\"https:\/\/www.growbarato.net\/blog\/wp-content\/uploads\/2023\/03\/analisis-de-cbd.jpg.webp\" alt=\"cbd for therapeutic use\" title=\"cbd for therapeutic use\"\/><\/figure>\n<\/div>\n\n\n<p><br>Currently, the Health Commission of the Congress of Deputies has created a sub-commission <strong>in charge of studying the legalization of medical cannabis for therapeutic purposes<\/strong>. It includes 15 people of all the political parties that have government representation and they should reach a conclusion before the end of June. Another one of its objectives is to derogate the gag law.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Legal_cannabis_crops\"><\/span>Legal cannabis crops<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Authorizations_that_allow_cannabis_crops\"><\/span>Authorizations that allow cannabis crops<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>There are some occasions when growing marijuana plants is legal.
