<strong>synthetic cannabinoid<\/strong> found naturally in the cannabis plant, albeit in minimal concentrations. The version that was marketed was almost always obtained in a laboratory through a <strong>hydrogenation<\/strong> process: hydrogen atoms are added to CBD (or in some cases THC), which modifies the molecular structure and alters both the potency and stability of the compound.<\/p>\n\n<p>From a chemical standpoint, HHC bears a <strong>great similarity to Delta-9 THC<\/strong>, but hydrogenation introduces small differences that alter both its potency and how it acts on the endocannabinoid system. For this reason, many describe it as having an intermediate effect: not as mild as CBD, but not as intense as THC.<\/p>\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Is_HHC_legal_in_Spain\"><\/span>Is HHC legal in Spain?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>No, HHC was included in the list of controlled substances via <strong><a href=\"https:\/\/www.boe.es\/boe\/dias\/2025\/04\/22\/pdfs\/BOE-A-2025-8109.pdf\" data-type=\"link\" data-id=\"https:\/\/www.boe.es\/boe\/dias\/2025\/04\/22\/pdfs\/BOE-A-2025-8109.pdf\" target=\"_blank\" rel=\"noopener\">provision 8109 of the BOE (No. 97)<\/a><\/strong>, published on April 22, 2025. The Ministry&#8217;s reasoning is based on three arguments:<\/p>\n\n\n<ol class=\"wp-block-list\"><li><strong>Psychoactive effects comparable to THC<\/strong>, with demonstrated potential for abuse.<\/li>\n\n<li><strong>Alignment with European regulation<\/strong>: Germany, France, Poland, and other EU countries had already banned it between 2022 and 2024.<\/li>\n\n<li><strong>Absence of long-term safety studies<\/strong>, which triggers the precautionary principle regarding public health.<\/li><\/ol>\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Before_the_ban_the_gray_area_of_HHC\"><\/span>Before the ban: the gray area of HHC<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n<p>For nearly two years, HHC circulated in Spain in a legal gray area: since it did not appear on any official list of prohibited substances, its commercialization was tolerated. This made it what many called &#8220;legal THC&#8221;: similar psychoactive effects, without the formal restrictions of traditional cannabis.<\/p>\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_is_HHC_no_longer_legal_in_Spain\"><\/span>Why is HHC no longer legal in Spain?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n<p>The factors that have made HHC no longer legal in Spain:<\/p>\n\n\n<ul class=\"wp-block-list\"><li><strong>Health concerns:<\/strong> although there are no specific studies in Spain, negative effects of HHC have been reported internationally.<\/li>\n\n<li><strong>Alignment with Europe:<\/strong> many EU countries had already banned it.&nbsp;<\/li>\n\n<li><strong>Lack of safety studies:<\/strong> not much is known about the long-term effects of HHC.&nbsp;<\/li><\/ul>\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_consequences_of_possessing_HHC_now\"><\/span>What are the consequences of possessing HHC now?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Difference_between_possession_and_trafficking\"><\/span>Difference between possession and trafficking<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n<p>The ban on HHC legally equates it to other substances in Annex I. In practice, the difference between an administrative sanction and criminal consequences depends fundamentally on the quantity and the context:<\/p>\n\n\n<ul class=\"wp-block-list\"><li><strong>Possession for personal use<\/strong> (small quantity, no signs of sale): this is treated as an administrative infraction under Organic Law 4\/2015 on Citizen Security, with fines that can range from <strong>\u20ac601 to \u20ac30,000<\/strong>, in addition to the seizure of the product.<\/li>\n\n<li><strong>Trafficking, sale, or distribution<\/strong>: this falls under the scope of the Penal Code (arts. 368 et seq.), with prison sentences of <strong>one to three years<\/strong> for substances that do not cause serious harm to health, and <strong>three to six years<\/strong> if it is considered that they do.<\/li><\/ul>\n\n\n<fieldset style=\"border: 2px solid #00A48C; background-color: #F9F9F9; padding: 20px; margin: 30px 0; border-radius: 8px; font-family: Arial, Helvetica, sans-serif; color: #333;\">   <legend style=\"font-size: 2.3rem; font-weight: bold; color: #00A48C; padding: 0 10px; margin-top: 15px;\">     Notice   <\/legend>   <p style=\"font-size: 2.2rem; line-height: 1.6; margin: 10px 0;\">     Following its regulation in Spain as of April 2025, HHC became subject to control. From that point on, the specific legal classification of each case will depend on judicial application and the expert assessment made of the substance and the facts.   <\/p> <\/fieldset>\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_you_be_sanctioned_for_products_you_bought_before_April_22\"><\/span>Can you be sanctioned for products you bought before April 22?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n<p>Technically, the law does not have retroactive effect on purchases made before the ban. However, possession as of April 22, 2025, can indeed lead to sanctions, regardless of when the product was acquired. The general recommendation from legal experts is not to keep stock or consume them.<\/p>\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"HHC_vs_THC_vs_CBD_How_do_they_differ_in_the_eyes_of_Spanish_law\"><\/span>HHC vs THC vs CBD: How do they differ in the eyes of Spanish law?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>Unlike CBD, which remains legal in Spain as long as it contains very low levels of THC <strong>(<0.2%)<\/strong>, HHC has ended up in the crosshairs for being quite similar to THC. While CBD does not alter perception, HHC <strong>does generate psychoactive effects<\/strong>, which has led to it being considered a substance with potential risk to public health.<\/p>\n\n<p>This similarity to THC, which has been banned in Spain for years except in highly controlled medical contexts, has been one of the main arguments for <strong>including HHC in the list of prohibited substances.<\/strong><\/p>\n\n<p>Added to all this is a key problem: the lack of serious, long-term research on its safety.
